Terms of Use

These Terms of Use ("Terms") govern your use of the FixFly app ("the app", "we", "us"). By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.

1. The service

FixFly lets you generate images and videos using AI from your photos and text prompts. Results are produced by third-party AI models and may vary in quality and accuracy.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the app.

3. Accounts

You can use the app anonymously or sign in with Apple. You are responsible for activity that occurs through your account. Signing in with Apple links your existing data to your Apple ID so it can be restored on other devices.

4. Purchases, subscriptions and coins

• Purchases (subscriptions and coin packs) are sold and processed by Apple through the App Store and charged to your Apple ID.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple ID settings.
• Coins are a virtual in-app item with no monetary value, are non-transferable and non-refundable except where required by law.
• Refund requests are handled by Apple according to the App Store's policies.

5. Acceptable use

You agree not to use the app to:

• create content that is illegal, hateful, harassing, sexually explicit involving minors, or that violates others' rights;
• upload images of other people without their consent, or impersonate others;
• create misleading content intended to deceive or harm;
• attempt to disrupt, reverse engineer, or abuse the service or its limits.

6. Your content

You retain ownership of the photos you upload and the results you generate. You grant us a limited license to process, store and transmit your content solely to provide the service (including sending it to our AI provider for generation). You are responsible for the content you upload and generate and confirm you have the rights to use it.

7. AI-generated content

AI outputs are generated automatically and may be inaccurate, unrealistic or unexpected. We do not guarantee any particular result and are not responsible for how you use generated content. You are responsible for ensuring your use complies with applicable laws.

Generation is performed by third-party AI providers, and some templates process your uploaded photo outside your country (including on servers in China for certain video effects). The providers we use and how your data is handled are described in our Privacy Policy.

8. Intellectual property

The app, its design, and its software are owned by us and protected by law. These Terms do not grant you any rights to our trademarks or branding.

9. Termination

We may suspend or terminate access if you violate these Terms or misuse the service. You may stop using the app at any time and request account deletion.

10. Disclaimers and limitation of liability

The app is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the app.

11. Apple App Store

This app is licensed, not sold, to you. The Apple Standard End User License Agreement (EULA) applies as a minimum. Apple is not responsible for the app or its content, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

12. Changes

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
